Sna Infotech Pvt Ltd Waybill is non-negotiable and the Consignor/Shipper acknowledges that it has been prepared by the Consignor/Shipper or by Sna Infotech on behalf of the Consignor/Shipper.
All shipments under the Waybill are carried at Owner's risk
By shipping materials for shipments via Sna Infotech, it is deemed that the Consignor/Shipper agrees to the terms and conditions stated therein.
In any circumstances whatsoever, the services provided herein by the Sanvee will not include any open delivery of the Shipments. Further, Sanvee is a just Service Provider and cannot be held liable in any manner whatsoever for either any defect in the product or misdeclaration in the context of nature, description and value carried from the CONSIGNOR of the Consignment or the authenticity of the Negotiable Instrument collected from the CONSIGNEE.
As a matter of course, all duties, value added taxes (VAT) or any other applicable taxes and all other charges including stamp duties levied on the Shipments during the transit of goods or services shall be payable to Sanvee by the CONSIGNOR, and if the same is to be recovered from CONSIGNEE up on the instruction of CONSIGNOR and in such circumstances if the CONSIGNEE/Receiver refuses to pay the above charges, in that condition the CONSIGNOR shall be unconditionally liable to pay the Sna Infotech the above amounts in full within 7 days of intimation by the Sna Infotech.
GST (Goods & Service Tax) E-way bill is an electronic waybill for movement of goods which is generated from GSTN (common portal). The Shipper should ensure compliance as prescribed under GST based on shipment value. Any non-compliance in generation of E-way bill by Shipper may result in delay in delivery/non-delivery of shipments booked.
The CONSIGNOR will keep Sanvee indemnified at all times against any demand by any Authority payable by CONSIGNOR/CONSIGNEE, which the CONSIGNEE refuses to pay the same and towards any kind of eventuality. In addition, The CONSIGNOR admits and acknowledges Sanvee right of lien on its Shipments/Consignments for any outstanding freight, any other applicable charges, and Sanvee may refuse to surrender possession of the Shipments/Consignments to the CONSIGNEE until all such charges are paid.
Further, Sanvee has the right to terminate the services with immediate effect but not limited on the happening of Noncompliance/non adherence of the specified terms and conditions by SHIPPER/CONSIGNOR, and SHIPPER/CONSIGNOR being found involved in any kind of illegal, criminal activities and adopting any kind of unfair business activities which are prohibited by law.
Immediately after termination of this Services for any reason what so ever, all amounts that have already become due and payable to Sanvee as on the date of termination of this Agreement, shall be paid by the CONSIGNOR without any protest and demur. Sanvee shall raise fresh invoice for the Shipments made/undertaken during the period commencing immediately after the date of the last invoice raised and expiring on the date of termination of the services, and Consignor shall be obliged to clear it’s all outstanding amounts, including the payment required to be made under such fresh invoice, within 7 (Seven) days from receipt of such invoice.
Sanvee recommends insurance of all Shipments/Consignments carrying anything of value, at the CONSIGNOR’S cost. For Shipments which are not insured, the maximum liability of Sanvee for any loss or damage to shipment attributed to Sanvee is limited up to Rs 5000/- per airway bill, and will be strictly regulated by the rules and regulations in respect of limitation of liability clauses, and will not exceed in any circumstances whatsoever as prescribed under the provisions of “The Carriage by Road Act, 2007 (No.41 of 2007)” and any subsequent amendments made therein.
Every shipment shall be charged by its chargeable weight, actual weight or the volumetric weight whichever is higher will be chargeable weight.
In case of any unresolved dispute, differences, controversy or claim arising out of this contract, shall be referred to a sole Arbitrator nominated/appointed by the Sanvee only in accordance with the provisions of Indian Arbitration & Conciliation Act, 1996. The arbitration proceeding will be in English language only and held at Mumbai and both parties shall bear their respective costs of Arbitration. The decision or the award passed by the sole Arbitrator shall be final and binding on both the parties and on any other party related to those consignments/Shipments under dispute in any manner whatsoever.
The Courts at Mumbai have alone jurisdiction with applicable Laws of India in this regard. Consignor shall ensure that the shipment handed over to the logistic partner is in proper, tamper proof, and damage proof packing of their brand. Consignor agrees that it shall use good quality tapes, duly engraved with Merchant’s trademark/name, and not generic tapes (i.e. brown/plain/transparent tape) for the packaging/sealing of the goods/shipments. Sanvee shall have no responsibility of any kind, in case of pilferage/damaged/alteration/tapering/ leakage, etc. of the goods/shipments, in case of any failure of the above packaging requirements by the consignor.
The Consignor agrees that all claims relating to damage/pilferage/tampering/leakage/fake delivery of the shipment must be notified to Sanvee in writing within forty-eight (48) hours of the delivery of shipment; and loss/theft of the shipment must be notified to Sanvee in writing within thirty (7) days of the shipment pickup date. Sanvee and/or its courier partner shall not be responsible for any damage to the shipments which include liquid, perishable or fragile items/products,
In case of damaged/pilferage/tempered/pressed/leaked shipment, receiver shall mention negative remarks on POD copy to get claim for the shipment. In the absence of any negative remarks on POD copy clearly stating such damage/pilferage/tampering/pressing/leakage, no claim shall be entertained by Sanvee at any point of time.
In case of non-acceptance of the RTO shipment by the Consignor or in case the consignor is not reachable for RTO shipment, Sanvee reserves the right to levy suitable demurrage/incidental charges for extended storage of such products for any period exceeding 7 (seven) business days from initiation of the returns and In case of non-acceptance of the products beyond 10 (ten) days from the first RTO undelivered date/first RTO delivery attempt date, Sanvee has the right to dispose such products and the Consignor will forfeit all claims in this regard towards the Sanvee also consignor will be required to pay charges for disposing the product, along with all other charges (including demurrage/incidental charges)
In case of any POD dispute (Shipment marked delivered but not received) Consignor shall raise the dispute within 48 hours from the time of delivered marked in the system for investigation.
Claims for any kind of damage/pilferage/tampering/leakage of the booked articles/goods/shipment shall be entertained only if the outer packaging done by the shipper is damaged/altered/tampered. However, if the outer packaging done by the shipper is intact and not tampered with, in such a case, no claim(s) for any damage/pilferage/tampering/leakage shall be entertained by Sanvee.
Consignor hereby agrees that it will not book / handover any good/shipment which is banned, restricted, illegal, prohibited, stolen, or infringing of any third party rights, or which contains any cash, jewellery (excluding artificial jewellery), gold, silver, diamond, platinum, precious metals, precious stones, currency, bullion, financial and security instruments, or any reactive, hazardous or dangerous items/goods which are in breach of any applicable law or of any packaging/transportation guidelines of the concerned logistics partner; in which cases Sanvee shall not be responsible and liable for the delivery of any such products, any loss, damage, theft or misappropriation of such products.
